Is Demand Signatures legally binding?

Electronic signatures can have legal effect, but using a signing service does not by itself guarantee that every document is enforceable.

Steps#

1. Identify the document type and the jurisdiction governing the transaction.
2. Check any applicable signing, identity, consent, witnessing or notarization requirements with your legal adviser.
3. Have each intended signer review the document and decide whether to sign.
4. Retain the completed document and the available signing records.

For transactions in or affecting interstate or foreign commerce in the United States, E-SIGN generally prevents a signature, contract or other record from being denied legal effect solely because it is electronic. Other requirements and exceptions still apply. See 15 U.S.C. § 7001 and § 7003.
